What sets your law practice apart from other practices?
Our practice takes a far lower contingency fee, and we believe that everything needs to be focused on our clients and their recovery, which includes as much financial remuneration as possible to overcome the results of their accident. We do a 25 percent contingency fee as opposed to what the industry standard is, which is a third or 33 percent.
How do you and your firm contribute to the motorcycle community?
Something we are excited about is our sponsorship with
RoadGuardians.org. In a joint effort, we will be sponsoring instructor-led
safety classes at the legends local Harley
chapters and bike shops beginning in February of 2020 so people can
learn what to do or how best to help if they find themselves at an accident
site in the first 5 to 30 minutes after a crash.
What types of results do you realize for your clients in Arizona?
We are a firm with a full team of litigators here, and we can you say that in Arizona to our clients that they get the most money possible in the most ethical way possible to support your recovery. We have represented a couple of hundred motorcycle accident victims successfully to date.
What can someone expect when they call your office?
First, they can expect to speak with an attorney when they call the
office, and they can expect to meet with an attorney when they come into the
office.
My whole thing for people who need our services here in Arizona is that
every client needs to meet with an attorney in order to build a bond and to
also know what they're going to have the same legal team that's handling their
case from beginning to end, that's the way we've always done it and that's the
way we're going to continue to do it.
Sometimes we've got our pre-litigation attorneys and then we've got our
litigation attorneys but within the office, if something cannot be resolved
pre-litigation we have a
very smooth transition into the litigation phase with
the litigating attorneys it's an all-team effort here in this office
Is there an upfront cost for the accident victim?
No, we work on a contingency fee basis. That's one of the first things that obviously comes up for victims, "all right, how much money is this going to cost me?". Well no it's not going to cost our clients anything if we're unsuccessful with their claim, they do not owe us anything we advance all the costs in their cases and once again if they're unsuccessful now wholly do not expect the clients to have to pay us back for the costs that we accrue during the process of litigation or pre-litigation
What if a victim is concerned and has questions, can they call you?
Absolutely, they can call me up, and we will answer any question and if we can't resolve their questions, we know almost all the attorneys in town, and we can point them in the right direction if that is best for them.
Do you provide defense services for DUI and criminal cases?
We have several attorneys that we refer to that do work in that area of the law.
Do you provide legal services for wrongful death? How does this work?
Yes, unfortunately, we are addressing wrongful death cases on nearly a
daily basis.
We treat wrongful death suit claimants with the greatest respect;
obviously this is a tragic situation for these particular families, and we
handle these cases judiciously and help these people out as much as we can.
What are the important questions asked after by victims after an accident?
The most important question that people ask is one we've already
touched upon. How much is it going to cost? Questions that I ask the clients
are things like; did you take pictures of the accident scene? What happened in
the accident? and What are you looking for from us? Then we move towards how we
can go about getting their issue resolved, and we lay out the game plan based
on what we have.
We explain how we're going to proceed and explain everything fully to
everyone so that they understand where we're headed and why we're going in that
direction and then also explain out the legalities and obviously there's
comparative fault issues and things like that which need to be reviewed on a
case-by-case basis.
That said, we take every case, and we prepare a game plan and explain
it to the clients in its totality so that they understand where we're heading
and then obviously how much time it's going to take and what the endgame result
is going to be
Can you help address immediate medical costs or motorcycle repair costs?
We do get those questions all the time, and the answer is that in most cases we can put everything on what's called a lien for the medical bills so that they don't have out-of-pocket expenses while they're trying to recuperate after an accident has occurred
How does what you do compare to "Law & Order" or "Matlock"?
I can give an example of how we handled a case where wrongful death occurred.
A recent case that we had was for the family of this poor guy who was
driving down the road and had a school bus take a left-hand turn in front of
him, and he ends up with his bike sliding under the motorcycle and he is struck
by the back wheels and died on impact.
We had questions of alcohol toxicity with our motorcycle rider client
and we had to go above and beyond to prove that that wasn't a factor in the
accident. We had to send out our experts and our investigators to prove our
point that regardless of the alcohol toxicity, that was not a factor in the
case it was the school bus driver who was a very elderly gentleman who was on
several medications and he was clearly at fault for the accident.
We had a bunch of hurdles as we'll put it that we had to overcome in
order to make that case work out and it worked out well for our client, the
wrongful death beneficiaries in that particular case and that's just one
example of many things that we've done in this office
